REGULATION NO. 1999/11

ON EXERCISING CONTROL OVER PAYMENTS FACILITIES AND SERVICES

The Special Representative of the Secretary-General,

Pursuant to the authority given to him under United Nations Security Council Resolution 1244 (1999) of 10 June 1999,

Taking into account United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 1999/1 of 25 July 1999 on the Authority of the Interim Administration in Kosovo,

For the purpose of providing facilities and services for use by UNMIK in connection with the collection, safekeeping and disbursement of public funds,

Hereby promulgates the following:

Section 1

Facilities

All facilities, including all movable and immovable property, located in Kosovo used by the Public Payment Service in Kosovo, with its headquarters at Leninit Street, Pristina, shall be utilized and administered by UNMIK.

Section 2

Governance

A Supervisory Board for Payment Operations (the "Supervisory Board"), consisting of three members of a high level of professional competence and integrity, shall be appointed by and shall be responsible to the Special Representative of the Secretary-General.
Members of the Supervisory Board shall serve at the discretion of the Special Representative of the Secretary-General.
The Special Representative of the Secretary-General shall appoint a President of the Supervisory Board from one of its members.
Section 3

Activities

The Public Payment Service in Kosovo shall, under the control and supervision of the Supervisory Board, and subject to the ultimate authority of the Special Representative of the Secretary-General, carry out collection, safekeeping and disbursement of funds to or on behalf of public institutions responsible for public funds, such as compulsory payments as defined in section 4 of UNMIK Regulation 1999/4, public sector salaries, emoluments and pensions.

Section 4

Staff

The Supervisory Board shall appoint persons of a high level of professional competence and integrity, including a general manager, to staff the Public Payment Service in Kosovo. The staff of the Public Payment Service in Kosovo shall be responsible to the Supervisory Board. The Supervisory Board shall apply non-discriminatory personnel policies, which shall ensure that the composition of the staff of the Public Payment Service in Kosovo reflects the multi-ethnic character of communities in Kosovo.

Section 5

Implementation

The Special Representative of the Secretary-General may promulgate administrative directions to implement the present regulation.

Section 6

Applicable Law

The provisions of applicable law shall apply subject to the provisions of the present regulation.

Section 7

Entry into Force

This regulation shall enter into force on 13 October 1999.
